GENERAL TERMS OF SERVICE AND PRIVACY
These conditions become effective at the moment you electronically accept the items “terms of service and privacy” or "terms of use" during registration via the Web (on the website https://www.drive-gym.com). In particular, acceptance of these conditions is mandatory for anyone booking for a competition or any online service and sending their personal data for job search purposes.
1. CONSENT – Receipt of EU Legislative Decree No. 679/2016 (privacy code)
By accepting this, the customer gives consent to the processing of the data entered by the website www.drive-gym.com, as per the information regarding art. 12 and following of EU Regulation 679/2016
2. Protection of personal data
Information on the processing of personal data pursuant to EU Regulation 679/2016. "Code regarding the protection of personal data" (hereinafter the "Code").
The personal data that are acquired through the website www.drive-gym.com are:
surname and name;
email address;
mobile number;
Such data are neither organized in databases or archives, nor retained by our company. However, they are required in order to communicate effectively with the customer; without them, it will not be possible to respond.
Drive-Gym may also collect other data (personal preferences, hobbies, and so on). It uses them to offer a service that is increasingly suitable and in line with the User's expectations, who can still choose whether or not to provide them. The nature of the services offered by the company does not involve the processing of sensitive data.

The data may be processed by Drive-Gym through electronic, automated, and manual tools for the proper provision of the service, in compliance with current regulations, using methods related to the purposes indicated above and, in any case, in a way that guarantees their security and confidentiality.
Always in full compliance with the EU Regulation, beyond what is strictly necessary for the execution of the requested service, the data provided will also be processed by Drive-Gym for the following purposes:
- send newsletters, respond to any requests formalized through the completion of the form in the "Contacts" section of the portal https://www.drive-gym.com, send invitations related to events, commercial information, market research, direct offers of products and services;
- send information and/or communications of an advertising nature about products and initiatives, from partner companies and/or associations, which may be considered useful for the User, without any transfer of data.
The data will be processed by employees who use them exclusively for achieving the described purposes, in accordance with the provisions of the EU Regulation.
It is specified that the data may also be communicated to other parties, such as consultants, collaborators, administrative staff, commercial staff, marketing, legal, credit institutions, system administrators, postal couriers, hosting providers, etc., always and only for the achievement of the purposes described.
It is specified, in this regard, that the data controller is Drive-Gym
The data subject may therefore request, by writing to info@drive-gym.com, the origin of the data, access to it, correction, rectification, restriction of processing, updating or integration of inaccurate or incomplete data, or the deletion or blocking of data processed in violation of the law, or may object to their use for legitimate reasons, to be specified in the request.
You may also withdraw the consent previously given, without affecting the lawfulness of processing based on consent before its withdrawal, and request from the Data Controller access to, rectification, or deletion of your personal data.
Drive-Gym reserves the right to make changes to this privacy policy in order to incorporate new technologies, industry practices, and regulatory requirements.
We will inform Users so that they can give their consent, should the changes be significant.
3. TERMS OF SERVICE - Obligations and responsibilities of the customer
Obligations:
To participate in races and use dynamic simulators, you must be of legal age.
Persons under the age of 18 may use the simulators if their parents sign a waiver, which can be found at the driving center, in which they assume full responsibility for the health conditions and any possible consequences of the minor's use of the simulator. The parent must in any case accompany and closely supervise the minor for the entire period of simulator use. THE PARENT is entrusted with the safety and responsibility of THEIR MINOR. DRIVE GYM SRLS IS IN NO WAY LIABLE FOR ANY PHYSICAL INJURY THAT MAY OCCUR TO THE MINOR SUPERVISED BY THEIR OWN PARENT.
For participation in the races, participants will be asked to behave correctly on the track even if there are no real risks of accidents. Unsportsmanlike conduct, aimed at damaging the performance of others, will be promptly assessed by our instructors who will have the authority to suspend the individual from group races, while still allowing them to run solo to complete the period of their reservation.
Responsibilities:
Clients who use the simulators available at a Drive Gym center accept any potential risks incurred during the activity and acknowledge that their participation in the activities is voluntary, as is any action taken during the course of the same, which is strictly voluntary and optional. They therefore assume personal responsibility for any consequences that may arise from such actions, both civilly and criminally.
As a consequence of the above, Drive Gym Srls is absolved from any liability that may arise in any way as a result of participation in the activity and for any damage to persons or objects during its execution.
4. Disclaimer of liability and authorization for the use of images
Anyone who uses the services of Drive Gym srls releases the company itself and/or all companies under the “Drive Gym” brand and sign, Collaborators, Partners, Sponsors (collectively referred to as the “Organization”), from any liability in relation to damage to persons or property that may be suffered and/or caused during the simulation activities, such as, by way of example, loss or theft of personal belongings, injuries during the simulation, or otherwise.
Anyone who uses the services of Drive Gym srls is aware that during the center's activities, photos, audio and video recordings may be taken and acknowledges that they may appear in some recordings. By accepting this clause, you authorize Drive Gym Srls to use such material. In particular, image rights are transferred free of charge, without territorial or time limits. By accepting these conditions, you therefore authorize the publication, distribution, and commercialization of the video and audio recordings, on any television channel, online, and on any social media managed by Drive Gym Srls.
In no case may claims be made against the author of the recordings and/or Drive Gym Srls for compensation for any moral or material damages caused by third parties or resulting from uses not provided for in this release.

The interested party may, therefore, request, by writing to info@drive-gym.com, the origin of the data, access to them, correction, rectification, limitation of processing, updating or integration of inaccurate or incomplete data, or the cancellation or blocking of data processed in violation of the law, or oppose their use for legitimate reasons, to be highlighted in the request.
You may also revoke the consent previously given, without prejudice to the lawfulness of the processing based on consent before revocation, ask the Data Controller for access, correction or deletion of your personal data.

3. CONDITIONS OF SERVICE - Obligations and Responsibilities of the Customer
Obligations:
To participate in competitions and use dynamic simulators, you must be of legal age.
People under the age of 18 years will be able to drive the simulators if their parents sign a release that they will find in the driving center where they assume full responsibility on health conditions and possible consequences of the use of the simulator by the minor. The parent must in any case accompany and keep under close observation the minor for the whole period of use of the simulator. Parents are entrusted with the safety and responsibility of HIS Parents. DRIVE GYM SRLS SHALL NOT BE LIABLE IN ANY WAY WHATSOEVER FOR ANY PHYSICAL HARM THAT MAY OCCUR TO THE CHILD SUPERVISED BY HIS OR HER PARENT.For participation in the races, participants will be asked to behave correctly on the track even if there is no risk of real accidents. Unsportsmanlike conduct, aimed at damaging the performance of others, will be promptly evaluated by our instructors who will have the right to suspend the individual from racing in groups leaving him free to run alone to conclude the period of his reservation.
Responsibility:
Customers who use the simulators present in a Drive Gym center accept any risk courses during the course of the activity and that their participation in the activities is voluntary, as is strictly voluntary and optional any taken action during the course of the same. They, therefore, assume personal responsibility for the consequences that may arise from such actions, both civilly and criminally.
As a result of the above, Drive Gym Srls is absolved from any liability that may arise in any way as a result of participation in the activity and for any damage to persons or property in the conduct of the same.
4. Disclaimer of liability and authorization to use the images
Whoever uses the services of Drive Gym srls, exonerates the same one and/or all the companies to brand and teaches "Drive Gym", the Collaborators, the Partners, the Sponsors (collectively denominated "Organization"), from any responsibility in relation to damages to the person or to things that had to be suffered and/or provoked during the carrying out of the simulation activities, as an example loss or theft of personal effects, accidents during the simulation or other.
Whoever uses the services of Drive Gym srls, is aware that during the activities of the center can be made photos, audio and video footage and is aware that it could be part of some filming. By agreeing to this clause you authorize Drive Gym Srls to use such material. In particular, the image rights are ceded free of charge, without limitation of territory and duration. By accepting these conditions you, therefore, authorize the publication, distribution and marketing of video and audio footage, in any television channel, online and in any social media managed by Drive Gym Srls.
Under no circumstances will the author of the filming and / or Drive Gym Srls for compensation for any moral and material damage caused by third parties or derived from uses not provided for in this disclaimer.
